It has been more than two Blackstone years since Michael resigned as a judge. But his troubles have followed him from the bench.
The Florida Bar will hold a hearing in February to determine whether Blackstone, now a private attorney, acted improperly when he represented a woman in an ongoing child custody case over which he had once presided as judge.
The case, Kimberly vs Partridge. Justin Hibner, Blackstone came before when he was a family law judge in April 2000. At the time, he appointed local attorney Denise Lyn to serve as guardian ad litem, or legal representative, for the couple’s young child.
Blackstone resigned from the bench on Aug. 31, 2000, less than two weeks before the state Judicial Qualifications Commission, which scheduled to hear charges that he had verbally abused lawyers, arbitrary decisions made under oath and lied about them when confronted.
Blackstone said he resigned because he did not think he would be given a fair trial. He then set up a private law practice.
In May 2001, Partridge contacted Blackstone after her attorney withdrew from her case. Blackstone agreed to represent her for one emergency hearing.
According to the complaint filed by the Florida Bar, Blackstone warned the opposing attorney, Patricia Moring, to determine whether there was any objection to his representation of Partridge.
Neither Moring nor demanded that her client Blackstone withdraw from the case.
However, he did not notify Lyn, which still represented the couple’s child.
Lyn objected to Black Stone’s presence at the June 5, 2001, hearing. However, the presiding judge allowed to continue the hearing.
Lyn later complained to the Florida Bar, accusing Blackstone of creating a conflict of interest by representing Partridge at the hearing.
The complaint Blackstone charged with violating the rules of the Bar by “representing a client in connection with a matter in which the lawyer participated personally and substantially as a judge or other officer adjudicative.
Blackstone referred all questions to his attorney, Scott Tozian of Tampa.
“His was not substantial participation in the case as a judge,” Tozian said. “That’s the crux of this case.”
Jan Wichrowski, the attorney representing the Florida Bar, said the complaint and spoke for itself that she was unable to discuss a pending case.
